Terms of sale, shipping and returns

1. Identification of the seller and scope
These Terms govern the purchase of products through https://www.indianflavours.es (the «Website») between Indian Flavours and persons acting as consumers or users (the «Customer»).

These terms apply to distance sales made to consumers resident in, or with delivery to, Spain and Portugal, within the zones enabled during checkout. If the Customer purchases as a business or professional for purposes related to their trade, they must first contact Indian Flavours; in that case, different terms may apply.
The contract is concluded in Spanish. The Customer may view and download these terms before confirming the order and will receive a purchase confirmation on a durable medium, usually by email.
2. Products and pre-contractual information
Indian Flavours offers packaged Indian and South Asian food products, such as spices, rice, flours, snacks and pickles, as well as certain cosmetic products. The catalogue varies according to availability and currently comprises several hundred items.
Each product page shows, before purchase, the product name, the price with taxes included, the size or quantity and its availability. Where we hold the manufacturer's data, we also publish the list of ingredients, the allergens, the nutrition information and the storage and usage instructions; how we do this is explained on our allergen information page, linked below. That publication is being rolled out gradually across the catalogue, so some product pages may not include it yet; in that case the Customer may request the information before buying and Indian Flavours will provide whatever it holds. The product image is indicative; packaging, labelling or presentation may vary between batches without affecting essential characteristics.
It is the Customer's responsibility to check the physical labelling of the product received before consuming or using it. If the Customer has allergies, intolerances or specific dietary needs, they must carefully check the ingredients and allergens. For any reasonable doubt, contact Indian Flavours before placing the order. The information published on the Website is indicative: the labelling on the packaging received always prevails.
Availability shown on the website is indicative and may vary. If, after purchase, a product is unavailable, Indian Flavours will inform the Customer as soon as possible and, where feasible, offer an equivalent alternative in features and price or refund the amounts paid for the unavailable product. No substitutions will be sent without the Customer's consent.
3. Purchase process
To place an order, the Customer must:
- Select the products and add them to the basket.
- Review the basket, quantities, prices and availability.
- Provide the requested billing and delivery details.
- Select the shipping method and view the total cost, including applicable taxes and delivery charges.
- Choose the available payment method.
- Accept these Terms, the Privacy Policy and, where applicable, the Cookie Policy.
- Confirm the order using the button that unambiguously indicates a payment obligation.
- Receive order confirmation by email, evidencing receipt of the order.
The contract is formed when Indian Flavours confirms acceptance and processing of the order. Automatic acknowledgement of receipt does not necessarily imply final acceptance where there are manifest errors, lack of stock, payment issues, incomplete data, impossibility of delivery or reasonable indications of fraud. In such cases, Indian Flavours will inform the Customer and, if the order cannot be fulfilled, will promptly refund any amounts charged.
The Customer must check the details in the confirmation and report any error as soon as possible. If an invoice is needed, the correct tax details must be provided during checkout or requested through the contact channels.
3.1 Sale of alcoholic beverages (over-18s only)
Alcoholic beverages are sold only to persons aged 18 or older. By placing an order that includes alcoholic beverages you declare that you are of legal age. We may ask for photo ID and we may cancel and refund any order when we cannot confirm that the buyer or the recipient is 18 or older.
The carrier may ask for photo ID on delivery and will not hand the parcel to anyone under 18 or to anyone showing clear signs of intoxication. If delivery cannot be completed for that reason, the order is returned and refunded minus the shipping costs actually incurred.
Alcoholic beverages may not be resold or given to minors. Please drink responsibly: alcohol is harmful to health and should be avoided during pregnancy and before driving.
4. Prices, taxes and promotions
Prices shown on the Website are expressed in euros and include VAT and other applicable indirect taxes, unless expressly stated otherwise. Before confirming the order, the total amount will be shown, itemising, where applicable, shipping charges and any other applicable cost.
Prices may change at any time, but the order will be invoiced at the price shown at the time of confirmation, save for manifest error. If an obvious pricing error is detected that the Customer could reasonably have recognised, Indian Flavours may cancel the order before dispatch and will inform the Customer accordingly, refunding any amount paid.
Promotions, vouchers and discounts are subject to their specific terms, validity period, stock levels and, where applicable, minimum order amount. They may not be combined unless expressly stated.
5. Payment methods
The available payment methods will be shown at checkout: credit or debit card via the bank's virtual POS (Redsys), PayPal and bank transfer. For bank transfers, the order will be prepared once receipt of payment has been confirmed.
Payment will be made through the selected payment gateway or method. Indian Flavours does not have access to, nor does it store, full payment card details where these are processed directly by the payment provider. The order may remain pending until the relevant entity confirms authorisation or receipt of payment.
6. Shipping: zones, costs and lead times
Indian Flavours ships to Spain and Portugal. The stated delivery time is 24 to 48 hours / 1 to 2 working days, counted from confirmation of the order and payment, unless otherwise indicated during checkout, or in the case of out-of-stock products, logistical issues, public holidays, adverse weather conditions or force majeure.
Lead times are estimates and are communicated before the order is placed. The availability for each zone, the carrier, the shipping costs and free shipping are shown during checkout as detailed below:

For the Canary Islands, Ceuta and Melilla, any applicable costs, formalities, taxes, duties or customs procedures, and who must pay them, must be expressly stated before purchase. If delivery to a zone is not offered, it must be disabled at checkout and must not be advertised as available.
Delivery will be made to the address given by the Customer. Deliveries will not be made to PO boxes if the carrier does not accept them. If the address is incorrect, incomplete, or the order cannot be delivered for reasons attributable to the Customer, additional costs may arise, which will be communicated before being charged, where the law permits.
The risk of loss or damage to the products passes to the Customer when they, or a third party indicated by them other than the carrier, takes physical possession of the goods. The Customer must inspect the outer condition of the parcel on receipt and report any visible issue in accordance with section 10.
7. Right of withdrawal
7.1 General rule
A Customer who is a consumer generally has a period of 14 calendar days from physical receipt of the goods to withdraw from the purchase without giving any reason and without penalty, subject to the legal exceptions described in section 7.2.
To exercise the right of withdrawal, an unambiguous statement must be sent to Indian Flavours before the deadline expires, by email to indian-flavours@hotmail.com or by post to Calle Joaquín Costa nº 64, 08001 Barcelona, Spain. The form included at the end of these terms may be used, although it is not compulsory.
Once the decision has been notified, the Customer must return the products without undue delay and, at the latest, within 14 calendar days of that notification, to the address indicated by Indian Flavours for returns: Calle Joaquín Costa 64, 08001 Barcelona, Spain.
Unless Indian Flavours expressly agrees to bear the cost, or the return is due to an error, lack of conformity or damage attributable to Indian Flavours, the Customer will bear the direct cost of the return. The Customer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics or functioning.
Indian Flavours will refund all payments received, including the standard delivery charges —not any extra costs arising from a more expensive delivery option voluntarily chosen by the Customer—, using the same payment method used for the purchase, unless expressly agreed otherwise and provided the Customer incurs no charge. The refund will be made without undue delay and, in any event, within a maximum of 14 calendar days from being informed of the withdrawal. Indian Flavours may withhold the refund until it has received the goods back, or until the Customer supplies evidence of having returned them, whichever condition is met first.
7.2 Important exceptions for food, hygiene and cosmetic products
The right of withdrawal does not apply in the cases set out in Article 103 of the Real Decreto Legislativo 1/2007 (Spanish Consumer Code). In particular, and for the avoidance of doubt:
- Perishable food products: goods that may deteriorate or expire quickly cannot be returned, pursuant to Article 103(d) of the TRLGDCU.
- Products sealed for health or hygiene reasons: sealed goods that are not suitable for return for health or hygiene reasons cannot be returned once unsealed after delivery, pursuant to Article 103(e) of the TRLGDCU. Depending on the product and its packaging, this may include certain sealed food and cosmetic items.
- Products inseparably mixed with other items: returns will also not be accepted for goods which, after delivery, have by their nature become inseparably mixed with other goods.
The exception does not apply automatically to all food items. Non-perishable food that has been properly stored and remains unopened, intact and fit for return may be subject to the right of withdrawal where no other legal exception applies. This policy does not limit the Customer's rights if the product is defective, incorrect, unsafe or non-conforming.

9. Legal warranty of conformity
Products sold by Indian Flavours are covered by the legal warranty of conformity provided for in the Real Decreto Legislativo 1/2007 and other applicable regulations. Indian Flavours is liable for any lack of conformity present at the time of delivery that becomes apparent within the legally established periods.
For goods, the trader is liable for any lack of conformity that becomes apparent within three years of delivery, unless a different period applies due to the nature of the goods or applicable regulations. For products with a short expiry or minimum durability date, the warranty will apply having regard to their nature, shelf life, consumption date and storage conditions, without prejudice to the Customer's rights if a lack of conformity existed at delivery.
The Customer must report the lack of conformity by email to indian-flavours@hotmail.com, stating the order number, a description of the problem and, if it helps process the claim, photographs of the product, packaging and batch. Indian Flavours may request reasonable information to verify the issue and will propose the legally appropriate remedy: repair or replacement where applicable, a price reduction, or termination of the contract with a refund, at no cost to the Customer where the lack of conformity is attributable to the seller.
This legal warranty is independent of any commercial guarantee the manufacturer may offer.
10. Damaged, incorrect or transport-affected orders
If the order arrives visibly damaged, opened, showing signs of tampering or does not match what was ordered, the Customer should:
- Record the issue on the carrier's delivery note or device, if possible, although this is not an essential requirement for exercising their rights.
- Take photographs of the outer packaging, shipping label and affected products, where possible.
- Contact Indian Flavours as soon as possible at indian-flavours@hotmail.com or by telephone on +34 650 59 33 00, stating the order number and a description of the issue.
- Keep the product, packaging and affected items until receiving reasonable instructions for collection, replacement or inspection.
Prompt communication makes it easier to claim against the carrier but does not reduce or condition the Customer's legal warranty or conformity rights. If an incorrect shipment, pre-delivery damage or lack of conformity is confirmed, Indian Flavours will bear the relevant return or collection costs and will offer the legally appropriate remedy.

We will endeavour to respond to requests as promptly as possible. Official complaint forms are available on request: they may be requested by email at indian-flavours@hotmail.com and the official form of the Generalitat de Catalunya, together with instructions for submitting it, will be sent to you.
12. Dispute resolution
The parties will endeavour to resolve any dispute in good faith through the customer service channel.
The former European online dispute resolution (ODR) platform stopped accepting complaints on 20 March 2025 and was discontinued on 20 July 2025 pursuant to Regulation (EU) 2024/3228. Links to that platform should therefore no longer be included: the authorities expressly recommend removing them from terms of sale and websites.
A Customer resident in another EU State, Iceland or Norway may contact the European Consumer Centre in their country (ECC-Net) or consult the European Commission's official list of alternative dispute resolution bodies at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies If resident in Spain, the Customer may approach the consumer affairs bodies of their autonomous region or the competent Consumer Arbitration Board.
As of this version, Indian Flavours is not a member of any consumer arbitration board or alternative dispute resolution body. This does not prevent the Customer from approaching the competent consumer bodies or the courts to which they are entitled by law.
Nothing in the foregoing limits the Customer's right to approach the competent consumer bodies or the courts that apply under the law.
13. Data protection
Personal data provided during the purchase will be processed in accordance with the Privacy Policy available on the Website. The data necessary to process the order, delivery, payment, invoicing and after-sales service will be processed to perform the contract and comply with legal obligations.
14. Amendment of the terms
Indian Flavours may amend these Terms due to legal, technical, operational or commercial changes. The terms applicable will be those published and accepted by the Customer at the time the order is placed. Amendments will not retroactively affect orders already confirmed, unless a mandatory rule requires otherwise.
15. Applicable law and jurisdiction
These Terms are governed by Spanish law, in particular the Real Decreto Legislativo 1/2007, of 16 November, and any applicable consumer protection regulations.
Where the Customer acts as a consumer, disputes will be submitted to the competent courts in accordance with the applicable mandatory rules, without prejudice to any out-of-court consumer mechanisms that may apply. This clause does not limit any non-waivable right of consumers.
